We are not responsible for delays, inaccuracies or limitations caused by incomplete, inaccurate or misleading information supplied by a client or third party.

4. Fees & Payments

Fees for our services will be communicated to you through our website, quotation, proposal, invoice or service agreement.

• Fees must be paid in accordance with the agreed payment terms.
• Where an advance payment is required, work may not commence until payment has been received.
• Additional services outside the agreed scope may attract additional charges.
• Applicable taxes, transaction fees or third-party expenses may be payable where stated in the applicable agreement.

Where included in your service, Askari may provide inspection reports, photographs, progress updates, observations, assessments or other deliverables.

Reports are prepared based on information, documents, observations and site conditions available to us at the time of the relevant inspection or assessment.

6. Client Responsibilities

To enable us to provide our services effectively, clients agree to:

• Provide accurate and complete information.
• Provide documents reasonably required for the engagement.
• Provide or arrange lawful access to relevant properties or development sites.
• Ensure that any access permissions or authorisations required for an inspection have been obtained.
• Pay agreed fees within the applicable payment period.
• Notify Askari promptly of any relevant changes to the project or engagement.

7. Intellectual Property

Unless otherwise agreed in writing, Askari retains ownership of its website, branding, logos, templates, methodologies, systems, processes and other intellectual property used to provide our services.

Subject to payment of applicable fees, a client may use reports and deliverables provided specifically for that client for their intended internal and investment purposes. They may not reproduce, resell, modify or commercially distribute Askari materials without our prior written permission, except where permitted by law.

8. Confidentiality

We will take reasonable steps to keep confidential information provided to us in connection with your engagement confidential, except where disclosure is required by law, necessary to provide the agreed service, or otherwise authorised by you.

Clients should also treat confidential information relating to Askari's business, methods and proprietary materials as confidential.

9. Limitation of Liability

Askari will provide services with reasonable care and professional diligence within the agreed scope.

However, our services are based on the information and conditions available to us at the time of inspection or assessment. We cannot guarantee future construction progress, developer performance, property values, investment returns or the outcome of a property investment.

Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.

10. Cancellation

A client may request cancellation of a service by contacting Askari using the contact details provided on our website or in the applicable service agreement.

The effect of cancellation will depend on whether work has commenced, services have already been performed, expenses have been incurred and the terms applicable to the specific engagement.

11. Termination

We may suspend or terminate access to our website or services where reasonably necessary, including where:

• A client materially breaches these Terms.
• Required payments are not made.
• Continuing the engagement would create a legal, regulatory or safety concern.
• Information supplied by a client is materially false or misleading.
• The relevant service or project can no longer reasonably be performed.

Termination does not affect rights, obligations or liabilities that accrued before termination.
